La Puya - Intimidación y Resistencia / La Puya - Intimidation and Resistance

La firma estadounidense de minería Kappes, Cassiday & Associates (KCA) y su filial guatemalteca, EXMINGUA, han impuesto el proyecto minero El Tambor en Guatemala. La operación se lleva a cabo sin consultar a los residentes locales como lo estipulan las leyes guatemaltecas e internacionales y a pesar de la rotunda y abrumadora oposición de la comunidad.

Durante los últimos 3 años, las dos comunidades  que bordean el sitio, El Carrizal y El Guapinal, han organizado una protesta pacífica en la entrada de la mina. Durante las 24 horas, todos los días de la semana, los residentes se turnan para hacer presencia y detener la explotación minera ilegal y la consiguiente contaminación de sus ríos y tierras.
“La Puya, Comunidad en Resistencia”, se ha convertido en un símbolo internacional, ellos y ellas defienden su derecho a tener participación, voz y voto en las desiciones respecto a la extracción de minerales de las tierras en las que han vivido tradicionalmente.

US mining company Kappes, Cassiday & Associates (KCA) and its Guatemalan subsidiary, EXMINGUA, have pushed forward the El Tambor mining project in Guatemala despite overwhelming community opposition – and without consulting local residents about the project, as required under Guatemalan and international law.

For the past 3 years, the two local communities of El Carrizal and El Guapinal, which border the site, have mounted a 24-hour 7 day a week peaceful protest at the entrance of the mine, against the illegal mining and consequent pollution of their rivers and countryside. 

La Puya, their ‘Comunidad en Resistencia,’ has become an international symbol for indigenous people’s right to have the deciding voice as to expropriation and exploitation of minerals and resources from their traditional land.

On May 23rd, 2014, the people of the Peaceful Resistance of La Puya were violently evicted from their protest camp, which they had maintained since March 2012 .

"The police fired dozens of tear gas canisters, injuring numerous locals. According to Asociación Mujeres Transformando el Mundo, a women's group, seven activists were taken the San Juan De Dios Hospital, including María del Rosario Rosales who was in her first trimester of pregnancy. A tear gas container allegedly landed on Eva Alvarez Díaz's head, giving her a skull fracture."

After their having filed a legal complaint in October 2014, on July 15 of this year, a Guatemalan court ruled in favor of local residents by ordering the suspension of KCA’s construction activity at the El Tambor gold mine until a community consultation is held and residents approve the project.


The court found that the company was operating illegally, “without permit, authorization or approval from the Municipality of San Pedro Ayampuc…to carry out its mining project” and that the responsibility falls to the Municipal Council to enforce the law.

“This passive attitude on the part of the State…could make the Municipal Council an accomplice to the impacts and damage caused by mining activities in its territory,” the community authorities had told the court, reminding them that “municipalities are obligated to denounce ecological disequilibrium in order to maintain a healthy environment.”

The court also ordered the municipality where the mine is located to ensure that EXMINGUA – the Guatemalan subsidiary of KCA – complies within 15 ‘working days’ of their decision, or by Wednesday 5 August.

"La policía tiró docenas de bombas lacrimógenas lastimando a numerosas personas. Según la Asociación de Mujeres Transformando el Mundo, siete activistas fueron llevadas al hospital San Juan de Dios, incluyendo María del Rosario Rosales quién estaba en su primer mes de embarazo. Al parecer también, una bomba lacrimógena golpeó en la cabeza a Eva Alvarez Diaz provocandole una fractura en el cráneo"

A pesar de éste violento ataque, su lucha continuó con apoyo  nacional e internacional.

Después de haber presentado una denuncia judicial en octubre del 2014,
el 15 de Julio de éste año, un tribunal guatemalteco falló a favor de los residentes locales, ordenando la suspensión de la actividad de construcción en la mina de oro hasta “que se llevara a cabo una consulta con la comunidad y los residentes aprobaran o no el proyecto.”

La Corte también encontró que “la empresa estaba operando el proyecto minero de manera ilegal, sin permiso, autorización o aprobación de la Municipalidad de San Pedro Ayampuc ... y que “la responsabilidad recae en el Consejo Municipal quien debe hacer cumplir la ley.”

Las autoridades de las dos comunidades también argumentaron en la Corte que “Esta actitud pasiva de parte del Estado…puede hacer cómplice al Consejo Municipal de los impactos dañinos de la actividad minera en su territorio”,   recordándoles que “las municipalidades tienen la obligación de denunciar el desequilibrio ecológico para mantener un medio ambiente sano”.

La Corte también ordenó a la municipalidad donde se encuentra la mina que se asegurara que EXMINGUA - la filial guatemalteca de KCA - cumpla dentro de 15 'días laborables' su decisión, o en su defecto para el miércoles 5 de agosto.

We had the honour of visiting La Puya on Sunday, 2 August, at their regular monthly celebration  of a Mass of thanksgiving for the support for their struggle from across Guatemala and internationally. 
They were also reflecting about the need to continue with the resistance, and to defend their lands from the contamination provoked by the mining.

After the service, members of the Community in Resistance gave us a tour of the site, and described the dangers to the local environment being caused by the mining of soil that already has an extremely high arsenic content.

Visitamos La Puya el domingo 2 de agosto. A nuestra llegada se celebraba la misa mensual de acción de gracias por los logros alcanzados. También se reflexionaba sobre la necesidada de seguir resistiendo y defendiendo el territorio de la contaminación provocada por la mina.
 

Después del servicio, miembros de la Comunidad en Resistencia nos invitaron a hacer un recorrido por el sitio explicándonos con más detalle los riesgos que representan para el medio ambiente local la extracción del mineral del suelo.
Al parecer, el suelo contiene altos niveles de arsénico.

Eusebio, Juan, Valerio y Candelaria nos llevan a ver la mina y nos comparten sus inquietudes sobre el grave impacto ambiental de la explotación minera de la compañía KCA.
Eusebio, Juan, Valerio and Candelaria took us to see the mine, and shared with us their concerns about the grave environmental consequences of KCA's mining operations.

We were shown images of rare birds that have been found poisoned and killed by the pollution caused.
We heard their concerns, in an area already suffering from a shortage of water, that their maize and other crops are dying due to a lack of access to water.  The mining company diverts  more river water in one day than a local family uses in 23 years!


During our walk, the residents also expressed their suspicions that KCA had found uranium ore on the site.
An independent enquiry has already concluded that no proper health and environmental checks had been carried out prior to the onset of their mining explorations.

 

Los residentes, nos mostraron fotos de aves que han encontrado muertas, envenenadas por la contaminación. También, nos compartieron la gran inquietud que tienen por el impacto que tendrá la mina en una zona que ya sufre de escasez de agua.  Actualmente sus cultivos mueren por la prolongada sequía y se preguntan que pasará cuando la empresa minera utilize en un día la misma cantidad de agua que una familia local consumiría en 23 años!

Durante el recorrido, también se insinuó la sospecha de los residentes de que además de oro, KCA ha encontrado uranio en el sitio, ésto aumenta la enorme preocupación de que la compañía no haya llevado a cabo los controles adecuados de impacto ambiental y de salud.

2 de Agosto. Juan nos expresó su profunda procupación por la presencia en la entrada de la resistencia pacífica de La Puya de cinco camiones portando materiales de construcción.
August 2nd. Juan expressed his deep concern at the presence of 5 vehicles carrying construction materials that had recently arrived at the entrance of the peaceful resistance of La Puya.

In spite of their welcoming the court decision, the residents were well concerned by the ongoing intimidation by KCA, in the form of 5 large lorries (laden with cement and other construction materials) that were parked less than 100 metres from where the service had been carried out.

 At the end of the afternoon, they had firewood delivered for the fires that continually provide tortillas and beens for visitors to share with the community.

Afterwards, as we and other human rights’ defenders returned to Guatemala City, and most of the resistance community returned to their homes, only two women remained behind ‘on site,’ one with her disabled daughter. All, for the moment, was quiet.

Al final de la tarde llegó una carga de leña para el fuego, las tortillas con frijol y el atol dan la bienvenida a todo aquel que se acerque  a visitarles.
Al final de una emotiva visita, emprendimos el viaje de regreso a ciudad de Guatemala, gran parte de la comunidad en resistencia regresaba a sus hogares, quedaban sólo  dos valientes mujeres guardando vigilancia, (una de ellas acompañada de su hija descapacitada). 

Al final de la tarde del domingo llega la leña para mantener el fuego vivo.

However, at 1am on Monday 3 August, the women on guard were driven from their sleep by the sound of a ‘battalion’ of police pick-up trucks filled with special forces entering the site, followed by the five lorries loaded construction materials. 

This cynical and further illegal initiative on the part of KCA, with the explicit support of Guatemalan State in clear violation of the spirit of the Court’s decision of 15 July, is a further manifestation of the Government of Otto Perez Molina’s actions in the interests of foreign multinational corporations, and Guatemala’s own oligarchy and the military’s own vested business interests, and against the rights and interests of local indigenous communities.

EXMINGUA, KCA’s local  ’agent,’ is administered by 'retired' members of the Guatemalan military.  So it is no surprise that the actions of the Guatemalan State exhibit their natural way of ‘resolving disputes’, ie.  by repression and intimidation.

Whilst this current setback now requires the Comunidad en Resistance to take up a renewed fight, the history of the past 3 years has shown that their determination,  and their capacity to struggle for their rights, and the interests of the wider region, will go on unabated.

Update:  In an article by journalist Jeff Abbott, quoted in a News Update by Guatemala Human Rights Commission USA, the CEO of Mining company KCA commented, arrogantly,

"I guess the protesters think that if they are obnoxious enough, the mine will go away."

Unas horas después de nuestra partida, a la 1 de la mañana del lunes 03 de agosto, las  mujeres fueron despertadas por el sonido de un "batallón" de la policía. Camionetas llenas de fuerzas especiales atacaron y rompieron la resistencia pacífica dejando ingresar a los cinco camiones cargados de materiales de construcción .

Esta nueva acción ilegal y cínica de parte de la compañía KCA, con el apoyo explícito del Estado de Guatemala, es una clara violación al fallo de la Corte del 15 de Julio y es una manifestación más del Gobierno de Otto Pérez Molina a favor de los intereses de las empresas extranjeras multinacionales y los intereses de negocios adquiridos por los militares. La acción viola impunemente los derechos e intereses de las comunidades locales.

EXMINGUA, es el agente local de la compañía KCA y es administrado por militares guatemaltecos retirados.
Por ello, no es extraño que las acciones tomadas para  resolver el conflicto sean la intimidación y la represión.

Mientras que este nuevo ataque demanda de la Comunidad en Resistencia una renovación de lucha, la historia de los últimos 3 años demuestra que su determinación y capacidad de exigir el respeto a sus derechos y el respeto a los intereses de la región en general, continúan.
